The Federal Communications Commission (FCC) is consulting industry players and the public on how the internet should be governed going forward.

The U.S. regulator saw its powers tested recently when cable and internet giant Comcast challenged the FCC's intervention on its peer-to-peer file sharing restrictions - and won. This case left the FCC with little power to impose any regulation on internet service providers and led to the agency reviewing how it should re-assert its authority on how the Internet should be governed.

The FCC now proposed three possible ways forward: to leave things unchanged, reclassify broadband using a complicated rule set which applies to the phone system, or - named the "Third Way" - reclassify broadband applying only a few of those rules. The latter does not include FCC regulation on internet access charges or any regulation of internet content, applications or services. It does, however, insist on principles which require cable firms to treat all internet traffic equally.

The agency is now consulting with the public on which option they prefer, inviting comments via its electronic comment filing system (search for docket 10-127).

The FCC said a third of all US households - 100 million Americans - do not have a broadband connection.

Meanwhile, it remains unclear whether any net neutrality rules will be applied to wireless companies offering mobile internet access.
