Judges Order Performance Pulsation Control to Pay Sigma Drilling Technologies Damages in Failed Appeal

Sigma Drilling Technologies (Sigma) has been awarded sanctions against Performance Pulsation Control (PPC) including repayment of legal fees as the Fifth District of Texas Court of Appeals finds PPC’s claims against Sigma are unwarranted.

The Court of Appeals, Fifth District of Texas at Dallas’ Justices Evans, Boatright, and O’Neill reviewed PPC’s complaint against Sigma and Justin Manley after the 416th Judicial District Court had rejected PPC's lawsuit twice before.

Justice David Evans rendered his opinion on December 17, 2018 stating “there was evidence Sigma owned the disk molding process for the CFC Kit. That evidence, when combined with other evidence that PPC was trying to reverse engineer the product, supported Sigma’s lawsuit.”

The court has found Sigma’s and Manley’s request for sanctions against PPC for bringing an unwarranted appeal “without any reasonable basis” and Rule 45 permits an award of damages to the prevailing party, in this case Sigma Drilling Technologies and Justin Manley. Justice Evans wrote. “Our decision to grant appellate sanctions is a matter of discretion that we exercise with caution and careful deliberation and only in truly egregious circumstances.”
