It was a very intense situation.

The sheriff's office is telling us it was that intensity and stress that caused bates to shoot harris instead of shock him with a taser.

The tulsa county sheriff's office is calling it a slip andrew capasso cure event.

A scientific phenomenon.

He thought he was using his taser when he actually pulled the trigger of a .38 caliber handgun.

>> because what's called inattentional blindness meaning that he wasn't consciously paying attention to registering it he wouldn't have been aware that the feel of the gun was different from that of the tears.

Bates reportedly jumped out of his car with a pepper ball gun in one hand.

His handgun in the other.

Bates stoled investigators during the chase he thought he put his gun away and grand his taser.

And investigators say nearly all of bates' actions were consistent with the intent to shock harris with (oJ&amp;hXA taser shoot him.

He did not have any intention to shoot mr. harris with an actual handgun.

The investigation has now been turned over to the d.a.'s office they have not yesterday made a determination whether criminal charges will be filed in this case or not.
