marcos: "how is the young girl doing? attorney: "frightened, very frightened. thank you." don now at five... 16-year-old marilee gardner... who was involved in a deadly car crash... makes her first appearance in adult court... don good evening. i'm don hudson. kim f and i'm kim fischer. thanks for joining us. kim f gardner is facing double murder charges... for a deadly crash in roy last week. good 4 utah's marcos ortiz was at today's hearing and joins us in the newsroom. marcos, what happened in court today? marcos the initial appearance doesn't really amount to much. formal charges are read and future dates are set. but it gave the public its first glimpse of the teen accused of what some are considering a horrific crime. :39-:46 [a6]abc4 generic animation wipe-server marilee gardner appeared overwhelmed during her first appearance in adult court.. the 16 year old is facing double murder charges. her only words ... responding to her name being called. marilee gardiner: "yes." gardner's accused of killing 20-year old madi haan and 19 year old tyler christianson. she allegedly struck their vehicle from behind. she is also accused of stealing the family's vehicle and running after an accident that involved a death. gardner's court appearance was a formality to hear the official charges filed against her. she also learned each of the murder charges carries a sentence of 5-years-to-life in prison. afterwards her attorney spoke briefly about the 16 year old. walter budgen, gardiner attorney: "not today nope. not today gentlemen." marcos: "how is the young girl? bugden: " frightened. very frightened." marcos: " does she understand the gravity of this situation?" bugden: "i'm not sure. thank you. she's only 16." family members of both gardner and the victims were also in court. off-camera, haan's step-dad spoke to good 4 utah about her death. scott castillo says "it hurts. i have a hard time talking about it. he says haan's funeral service will be held friday in roy. as for seeing the person responsible for madi's death .... castillo says he'll let the justice system take care of gardner. he says: "it's not my place to judge. i'm sure her family is hurting as well. i'm just her to support madi's family and what happens, happens." marcos gardner has been in custody in a juvenile facility. it's unsure whether she will remain there or be transferred to the adult jail in weber county. her next court appearance is july 27th. in the newsroom, marcos ortiz, good 4 utah.
