Visit c1 3 killing a ten-year- old in a drunk driving wreck... wasn't the only one involved who may have been drinking that night.

Good afternoon, i'm tom kenny... and i'm veronica jean seltzer..

A woman accused of causing a crash that left a 10-year- old girl dead had more than just alcohol in her system.

That's according to an officer who took the stand today at a hearing for sequoyah collins.

Abc 36's christy bollinger is in the studio with our top story at five.

In court, we learned sequoyah collins isn't only accused of driving with a blood alcohol level nearly triple the legal limit...but she's also accused of having cocaine in her system on the night of that july 5th crash.

Collins is accused of drinking and driving over 80 miles per hour...running a red light...and wrecking at the intersection of tates creek road and landsdowne drive.

That crash killed 10-year-old alexia gomez hernandez.

We're also learning new details about the driver of the car hernandez was in.

In his testimony today, a lexington police officer with the crash reconstruction unit said that driver didn't have a license.

"he also did admit to drinking previously in the night but he said he stopped drinking approximately two hours before the collision."

Officers found no signs of impairment so they didn't give him a blood test.

According to police testimony, there were also more people in the backseat than there were seat belts...and though the surviving passengers say they were wearing belts...police say they couldn't prove that because the car was so damaged.

Collins' attorney asked the judge for a lesser charge of manslaughter...to reflect his client didn't mean to hurt anyone.

But the judge kept collins' murder charge...and the case now heads to the grand jury to see whether there's enough evidence to formally charge her.

Three georgetown men are behind bars.... for a lexington murder.

This morning... lexington police announced 18-year- old jah'quez crutchfield..... 20- year-old rafael malik brewster and 18-year-old moses thompson were arrested in scott county... charged in connection to the murder of 19-year- old nathaniel shelby.

Crutchfield and brewster are charged with murder.... thompson with facilitation to murder.

All three are charged with robbery.

According to police.... shelby was shot over a drug dispute on september 3rd at an apartment complex off east reynolds road.

The fayette county coroner's office says shelby was prounced dead saturday at u-k hospital.

The family of a woman killed in the gas line explosion in lincoln county back last month is suing the company that owns the pipeline.

The lawyer for the family of 58-year-old lisa derringer released this never before seen security camera video... showing the explosion.

58-year-old lisa derringer was trying to escape the explosion when she was killed.

Her family has filed a lawsuit against enbridge.

Fs txt bullets:no family sues over deadly explosion lincoln county failed to inspect, maintain, monitor e ... according to court documents... the family is accusing enbridge of gross negligence and wrongful death for... among other things.... failing to properly inspect, maintain and monitor its equipment.

Failing to properly secure the area surrounding the equipment.

Failing to provide adequate warning of potential hazards.

Failing to correct or remedy the dangerous situation that existed at the site.

The family's attorney tells us they feel like enbridge failed to keep people safe... and they want the company to take responsibility for it.

"it's not something that just happens.

It's something that happens of result of years of neglect or years of ignored warnings and we have no doubt that those are the things that occured here."

Findley says enbridge filed an answer to the lawsuit and denied everything.

We reached out to enbridge.

The company says it won't comment on pending litigation.

A vote this afternoon could mean a bigger jail for madison county.

The madison county fiscal court has voted in favor of a property tax increase in order to fund a new jail.

That jail has been plagued with overcrowding issues for years.

The cost for the new jail is estimated at $45 million.

This would be the first tax raise for the county in decades.

Even though it was approved.... this is far from a done deal.

Abc 36's alexus larson will tell us why coming up in our next half hour.

A sorority has responded after the university of kentucky says it's under investigation.

Uk says it's the alpha chi omega sorority.

The university has not said why the sorority is being investigated.... just that they are taking the investigation quote: very seriously."

The sorority released a statement tuesday saying: we have spoken to university officials and are working to understand the allegations made against members of our chapter.

Our hope is that we can partner with the university as they conduct their announced investigation; we remain committed to holding our members and chapters accountable if policy violations occur.

Alpha chi omega joined the university in november 20-15.

A florida couple who brought their son to kentucky to keep him from undergoing chemotherapy treatments will not be getting him back.

L3: white parents of boy with cancer denied custody on monday.... a judge denied joshua mcadams and taylor bland-ball's request to regain custody of their son noah.

Doctors diagnosed the four-year-old with leukemia earlier this year.

His parents say they were looking for alternative treatments and a second opinion... when they brought him to georgetown.

In his decision monday... the judge cited what he called joshua mcadams' quote "anger issues."

The judge also recommended both parents get mental health evaluations.

Noah has been in his grandparent's custody.

C1 3 a kentucky lawmaker is resigning.... citing his belief in term limits republican state representative tim moore submitted his resignation in a letter to governor matt bevin.

His resignation took effect today.

Moore represented a house district covering grayson county and part of hardin county.

In his letter... moore stated says he's long believed in term limits and says it's time to quote: "apply that principle to myself."

Moore has served more than 12 years in the legislature a special election to fill his seat is set for november 5... the same day as kentucky's election for other statewide offices.

A kentucky soldier killed in world war two is coming home.

The department of defense announced monday the remains of army private first-class jacob givens were identified in june.

The mount sterling native was 30 when he was killed while fighting in germany.

Givens will be buried november 9 in prestonsburg.

It's the most recent staff shake up at the white house.

President trump announcing in a tweet that he has fired his national security advisor john bolton.

The president writing that he told bolton last night his services are no longer needed and added quote "i disagreed strongly with many of his suggestions, as did others in the administration."

But bolton tells abc news he was not fired - that he offered to resign and confirmed it this morning.

The president and bolton were recently at odds on several key foreign policy issues including north korea, iran and negotiations in the us with the taliban.

In may, bolton said that north korea's short range ballistic missile launches were a violation of a un security council resolution.

The president downplayed those tests and said he was not personally bothered by them.

Bolton is the third person to serve as national security adviser in the trump administration.

The president says he'll name a new national security advisor next week.

18 year old simah herman says - she feels lucky to be alive sot - herman: "it was terrifying weaker and weaker by the minute."

After two years of chronic, habitual vaping - first with e cigarettes and then a thc vaping device - simah says one day she had difficulty breathing.

After being rushed to the hostpial - she was put into a medically induced coma and attached to a ventilator for several days.

She is now reovering sot - herman: "i'm just trying to share my story and save people's lives."

Officials across the counrty say - they're battling a vaping epidemic sot presser houston: "this is a new outbreak which is occurring across the nation.

Close attention to what their children are doing when it comes to vaping."

And young people - appear to be most in danger sot presser houston: "the cdc is working with the states to further refine what may be behind this what's actually causing it.

But the message i think through and take home is that currently something has changed about vaping."

The fda -under pressure from congress --has issued a warning letter to e- cigarette industry leader - juul, accusing them of illegally marketing their product as a safer alternative to cigarettes - including a company representative making those claims to students at a school - despite failing to provide scientific data to back it up sot - dr. kathryn: "there's a lot we don't know about the both short term and long term consequences of vaping."

Health officials haven't identified any particular product or device as the source of the illnesses.

The majority of patients have reported vaping marijuana products or e- cigarette devices purchased on the street.

Tag: the cdc now reporting six deaths and investigating more than 450 cases of vaping related illnesses - and is urging people to consider not vaping or using e-cigarette products.

That's how joe catt says he reacted to the news his dog callie was selected as a winner in the all american dog contest.

Joe catt, owner: it was on facebook and it was just a whim and i didn't really think she had a chance to win with all the dogs that had been entered in the contest.

Nat: "and we got tens of thousands of entries."

Dallas cheatham, with early times, which held the contest... says the toy australian shepherd quickly rose to the top.

Dallas: "she just has a really compassionate nature."

The nine year old dog was one of ten selected across the country... nat "she's spoiled rotten."

And rightfully so... callie is now on this billboard at 248 big run road.

Joe: "to think that i own a dog that made it on a billboard."

And that's not all.... joe: "she also got an early times whiskey barrel dog house which is just fantastic."

Plus... dallas: "early times 2020 all american dogs calendar, callie's got her own special page."

Nat and while catt says callie isn't really into tricks, she is a fan of one... nat 'callie get your mail'... well, at least getting it.... nat "ahh!

Catt jokes... nat: "hollywood"... that billboard will feature callie throughout the month of september.
