Low lake levels issue taken to court

Lake Freeman's water levels are decreasing significantly.

A local environmental group is taking the matter to court.

With details on the case.

Good morning, marvin.

Good morning, marlee.

Earlier this month shafer freeman lakes environmental conservation corporation had oral arguments with u.s. fish and wildlife on october 5th.

Both groups are hoping for a decision within 30 to 60 days.

As news 18 previously reported lake freeman levels are down more than 10 feet.

In court sflecc argued that u.s. fish and wildlife's mandate was erroneously passed by the federal energy regulatory commission.

The mandate requires nipsco to keep water flowing toward the oakdale dam to preserve what the organization says are endangered mussels.

Home and business owners living alongside lake freeman say that low lake levels on top of an abnormally dry season has really put them i bind.

"we are looking for a win, win, win situation.

Right now the only win is on u.s. fish and wildlife because they are getting the amount of water they want."

It's important to mention that sflecc does not want endangered mussels to die.

However if things work out in the group's favor it hopes to create a plan with u.s. fish and wildlife.

The plan would be a compromise on how not only keeping the mussels safe but protecting lake levels as well.
