New details... evidence of gambling and drinking will be part of the limestone county sheriff's upcoming criminal theft and ethics trial.

Alex, sheriff mike blakely lost his fight to keep the evidence away from a jury.

Today -- the newly appointed judge to the case side with the prosecution.

She ruled against the defense's efforts to keep evidence related to gambling and drinking out of the trial.

The sheriff's attorneys argue prosecutors want to assasinate the sheriff's character by taking legal action and quote making it sinister.

Prosecutors say they have no intent on doing that and need the evidence to prove blakely's guilt on specific charges.

The judge is also considering wehther or not to allow state financial audits in the trial.

The defense says the audits will prove no money was actually missing.

But prosecutors say the audits would not prove anything since some of the theft charges relate to how the sheriff spent the money, not whether or not it was out of place.

The judge says she will enter an order once she makes a decision.

She also expects to meet with all the attorneys the week of may 17th to discuss logistics in the case.

Jury summons will be sent out at the beginning of next month.

A questionarre to produce a more efficient trial will then be sent 2 weeks after.

The judge and all the lawyers involve say they expect a normal trial without any social distancing this summer.
