A Madison County teenager charged with capital murder asked a judge to release him on electronic monitoring, fearing for his life after his brother was killed inside the same jail earlier this month.

A madison county teenager - charged with capital murder - made a court appearance today.

Hasaan erskine asked a judge to release him on electronic monitoring after his brother was killed inside the madison county jail earlier this month.

The two brothers are accused of killling - charity fennell - after robbing her in a drug deal at a vacant home in north huntsville in 20-18.

Dan, najahe- the judge hasn't decided just yet if hasaan erskine will remain in jail or if he will be released- today's hearing lasted about an hour with everyone including family and erskine himself being allowed to plead their case about his release to the judge.

Erskine nat "long live my brother" that's what 19-year-old hassan erskine told me as he left court tuesday morning- pulling down his face mask to make sure his message was clear.

Erskine has been in isolation in the madison county jail since october 9th when his brother, terran burt, was murered in the jail.

Tuesday, erskine appeared in court to ask a judge to release him from jail on electronic monitoring because he fears for his safety- and wants to be with his mother who is dying of cancer.

Erskine's mother also pleaded to the judge that she lost one son and doesn't want to lose another..adding that she is dying and doesn't have long to live.

Madison county assitant district attorney bill starnes told the judge he doesn't think erskine should be released from jail because he's been on electronic release before- shortly after he was charged with capital murder- and violated the terms of his bond including firing a weapon.

Erskine's attorney said his client has matured since the murder happened in 20-18.

Madison county sheriff kevin turner told the judge that erskine is being held in a protective isolation cell for his safety.

If he's not released from jail, erskine has requested to go back to general population to be close to other family members in the jail.

Erskine's attorney also told the judge that his client was invovled in a fight in the jail hours after burt's death, and his attorney referred to the jail murder suspect's friends as a quote street gang.

End qoute the family of the woman erskine's accused of killing was also in court today.

The sister of the victim in that case, charity fennell, spoke directly to the judge and erskine... saying that her family knows the pain that erskine's family is now feeling she said she wouldn't feel safe if he is released on electronic montioring.

This evening, we are still waiting for the judge to decide if erksine will be released or not... it's unclear when that decision will be made.
