DOJ sues after California moves to reinstate 'net neutrality'

The U.S. Justice Department filed suit after California Governor Jerry Brown signed legislation to restore open internet protections known as net neutrality in the state after the Trump administration repealed the rules in December 2017.

The U.S. Justice Department is suing California... after the state said it would restore net neutrality...setting up a face-off between the most populous U.S. state and the Trump administration, which repealed the Obama-era rules last year.

California Governor Jerry Brown on Sunday signed legislation that would reinstate open internet protections, preventing companies from slowing down or blocking online traffic.

Just hours the signing, U.S. Attorney General Jeff Sessions said in a statement that "states do not regulate interstate commerce - the federal government does.

And the DOJ warned that internet companies cannot realistically comply with one set of standards for California and another for the rest of the nation.

California's Attorney General Xavier Becerra - on the other hand - argues that the Trump administration is ignoring "millions of Americans who voiced strong support for net neutrality rules" And said California - which is known as a tech industry hub - will not allow a handful of power brokers to dictate sources for information or the speed at which websites load.

California's net neutrality law is set to take effect on Jan.

1, unless the Justice Department secures a preliminary injunction to block it from taking effect.
