Witnesses called in homicide trial of Erik Sackett

Witnesses are being called in the La Crosse county homicide trial of Erik Sackett.

The La Crosse man is accused of killing the woman he was seeing, Erin Somvilai and dumping her body in a Vernon County Lake.

Witnesses called in homicide trial of Erik Sackett

Today the jury is sworn in to hear the opening arguments in the homicide trial for a la crosse man accussed of killing his former girlfriend.

News 8's jordan fremstad joins us live with a recap of opening testimony from the la crosse county court house.

Martha after the jury heard opening arguments from the prosecution and the defense witness testimony began with sackett's parole agent from the department of corrections.

Sackett did not have permission from the agent to even be in a relationship with somvilai due past behavior.

But the defense focused on the problems somvalai had in her life including an arrest that happened just days before she dissapeared.

After the jury heard the opening statements the first witness was called to the stand in the homicide trial for erik sackett.

Sackett was supervised by parole agent amanda kinyon with the wisconsin department of corrections because of sackett's past behavior.

"is it your testimony that at the time that mrs. somvilai called you that she and mr. sackett were in a romantic relationship?"

"no i did not."

Kinyon told the court sackett did not have permission to be in a relationship with somvilai.

Officer aaron westpfahl with the la crosse police department responded to an incident in may of 2018 involving somvilai .

"there was a report of a battery or disordely conduct of some sort."

Yes there was."

Somvilai was arrested on may 31st at her home by officer westpfahl.

"you noted in your recorded interview with mr. bushek that you believed erin to be under the influence of something.

Is that correct?"

I did yes."

That was your impression of ms. somvilai when you arrested her on may 31."

"yes."

"you found ms. somvilai to be the primary aggressor in that incident?

Correct."

The defense focused on somvilai's drug problems and mental health issues.

That included text messages that showed she was frustrated with sackett who began seeing another woman.

In the opening argument sackett's lawyer showed the jury a photo that somvilai sent to sackett of cuts that appear to be self-inflicted.

Erin sent erik a text asking him how much it would be to purchase a nine milimeter firearm.

Again implying from our previous discussion that she wanted to shoot herself and end her own life.

Somvilai's father was also asked if she had problems. "am i correct in assuming that due to some concerns with her behavior that you had a discussion with her about taking the kids and having her stay with their father for the summer."

"correct."

Inspite of the defenses arguments the procecution reminded the jury sackett had not been truthful about where he was that sunday night.

"what do the circles represent?"

"the circles represent the approximate location according to the nelos data of this specific cellular device."

" is it safe to say that cellular device would be somewhere in those circles during those times?"

"yes sir."

"it includes most of northern vernon county.

It includes runge hollow lake?"

"yes."

"would it have helped investigators to know that erin was at runge hollow lake on sunday with erik sackett?

"yes."

Survellance video from a nearby neighbor places sackett's truck in the area of her home the night of june 3rd the day before she went missing.

Neighbors also reported seeing sackett at somvilai's home on that same night.

Thanks jordan, the defense also argued somvilai's body had a presence of amphetamine in her system that was high enough to kill her.

However the pathologist who performed the autopsy says in the report somvilai had been prescribed medication consistent with what was found in her body.

He did not believe it was a
