The city of Fort Wayne says the protester who lost his eye during protests in May, 21-year-old Balin Brake, lost it as a result of his own actions.

Thanks for joining us.tonight -- the city of fort wayne says the protester who lost his eye during protests in may lost it... as a result of his own actions.balin brake was hit in the face during the protests outside the allen county courthouse.the city responding to an american civil liberties union lawsuit claims the police department used excessive force....and also violated brake's constitutional right.this includes 'john doe' the officer who fired the gas cannister.the response says brake was not peacefully protesting and running from police but rather at police.it also says the use of force in the protests were reasonable.

The response does acknowledge the gas cannister never skipped or bounced off the ground... as previously stated by fort wayne
