Late wednesday... a federal judge ruled the governor's order cannot apply to private, religious-based schools across the state... saying it violates schools' constitutional rights.
However... he ruled the order can remain in place for public schools.
The governor says his team has already appealed the decision to the sixth circuit.... requesting an emergency stay of the judge's order.
Governor beshear says he also appeal to the u-s supreme court if necessary.
