Hours on the witness stand today.

And, soon, his fate will be in the hands of the jury.

Newschannel 2's joleen ferris reports from the oneida county courthouse.

Jason d'avolio spent about five hours on the witness stand in his own murder trial today, trying to convince the jury he didn't kill his wife, but rather, that she killed herself, using a long gun he had bought three months before her death.

He told the jury she was proficient at hangling a gun from her rotc days .

None .

None 10:23:44 one of those replica rifles you would use and twirl and practice, she would do competitions with it, they actually won awards" he said he bought a long gun in april 2019 to hunt with his brother.

But that when kerilee didn't want it in the house, he gave it to her 10:46:13 "i gave her the gun and the box.

I gave her the bag that held all the accessories with the receipt, said i don't like the dang things, anyways, said sell it, pawn it get rid of it, i don't care what you do with it" the prosecution asked why he didn't just return it for 300 some odd dollars, since the two had financial problems. jason d'avolio said his estranged wife told him she wanted to be single.

But, still , he pleaded 11:50:07 "it's reallys sad.

All i have asked from day one was to give me a chance.

To open your heart, stop pushing me away" 10:50:21 "i know i can make you happy" d'avolio says his wife killed herself in their home while their three young daughters slept and that he never heard a gunshot.

He describes the scene he walked in to 12:15:09 "i'm looking and i see that the curtains have got like dots on them.

The ceiling has got like dots on them" 12:19:53 "and i looked at her head and it was mushroomed up...it was kind of mangled and then i realized everything i was seeing at this point" d'avolio said he went to price chopper for more cleaning supplies to clean up the mess before his daughters woke.

He left them, ages 2 to almost 6, alone in the house.

The prosecution used jason d'avolio's own journal and messages to his wife to tell a story of escalating rage from rejection.

D'avolio told the grand jury this 14:10:37 "my wife and i have had an amazing relationship together.

We never really argued.

We never really fought" but d'avolio did this 14:10:50 'truth is, mr. d'avolio, is that you yourself recorded upwards of 150 arguments between you and kerrilee" stand up no court election day.

Back 9:45 wednesday for closing arguments.
